This is an action to recover real estate taxes for the years 1975 and 1976 paid under protest. The property in question is
a single-family residence owned by the Sisters of St. Mary, a non-stock, non-profit hospital and used exclusively as the residence
of the full time hospital chaplain. The hospital claims the property is exempt from real estate taxation. The City of Madison
appeals from a judgment holding the property was exempt from taxation under sec. 70.11(4m), Stats. The complaint alleges the collection of the taxes on the property is unlawful and illegal because the property in question
is exempt from taxation both as property owned by the plaintiff and used exclusively for the purposes of a non-profit hospital
under sec. 70.11(4m), Stats. (1975), and as property owned by the plaintiff and used for housing for members of religious
